Summary of Practice
Michelle's practice focuses on estate planning, trust administration, and probate.
Michelle's estate planning practice includes drafting revocable living trusts, including trusts designed to minimize estate taxes for married couples, and to avoid probate and facilitate the distribution of assets for all clients. She also prepares wills, durable powers of attorney for asset management, advance health care directives, community property agreements and other property agreements. Michelle enjoys representing a variety of clients, including single persons, married couples, and domestic partners, and working with clients with a variety of assets and estate planning wishes.
Michelle handles all aspects of post-death administration of estates and trusts. Her practice includes trust administration on the death of the first spouse, including allocation of assets to subtrusts and subtrust funding, administration on the death of the second spouse including estate tax matters and distribution to beneficiaries, and administration of the single person trust. Her practice also includes probate administration, including traditional probate, spousal property petitions, and small estate administrations, as well as a variety of probate court petitions. She also assists clients with all forms of post-death transfer of real property, including terminations of joint tenancy and affidavits of death of joint tenant, community property with right of survivorship terminations, distribution of property from trusts and probate estates, and attendant property tax matters.
Michelle's practice also includes assisting her clients with estate tax matters, gifting and gift taxes, step-up in basis issues, and related tax planning.
Michelle has been certified by the State Bar Board of Legal Specialization as a Certified Specialist in Estate Planning, Trust and Probate Law.
She holds a "BV" rating from Martindale-Hubbell, a nationally recognized attorney rating firm.
Professional Organizations
Michelle is active in the local legal community. She has been a board member of the Santa Cruz County Bar Association since 2002, including serving as Treasurer in 2004 and 2005, and President in 2007. She is a member of Women Lawyers of Santa Cruz County, and served as a board member from 2000 through 2005, including serving as President in 2004. She is also a member of the Santa Cruz County Estate Planning Council.
Community Involvement
Michelle is an active member of the Rotary Club of Santa Cruz, and has served on the Endowment Board of Trustees, and as Editor of the weekly club bulletin.
Publications and Presentations
Michelle has given presentations on estate planning and estate tax, including presentations on estate planning for people with children, and on major things to consider in creating an estate plan. She is a regular contributor to our office newsletter with estate planning and tax information. She has also spoken at the State Bar Annual Meeting in her capacity as President of the Santa Cruz County Bar Association.
